What is an Injunction Court Bond?
An injunction is a court order that requires a person to do something or stop doing something. Complainants may apply for a court injunction that asks the judge to forbid the offender from doing a specific act. An Injunction Bond guarantees that if the injunction order is found to be improper, the party for whom the injunction was put against is “made whole”.
How does an Injunction Court Bond Work?
There are 3 different types of injunctions that may occur:
Temporary injunctions: These may be known as a restraining order. These are typically for a small timeframe and set in place before a Preliminary or Permanent Injunction
Preliminary injunctions: these are issued at the beginning of a case and may be temporary but also can be long term.
Permanent injunctions: these are final and long term. They remain in place indefinitely.
These bonds guarantee a plaintiff will pay court fees, damages, and court cost related to the order should the court rule that the injunction is not valid or should not have been granted. Should a defendant suffer damages during the injunction period, they can make a claim against the bond for the amount of the damages, but only up to the face value of the bond.
